​Anthony W. Personal Injury - Even the most cautious person can't always anticipate the actions of others.  However, if you've been injured as a result of a, car, truck or other motor vehicle accidents; accidents caused by defective products; slip-and-fall accidents or other premises liability accidents; then you may be entitled to monetary compensation.  Insurance companies are in business to make a profits, they do not have you, the victim's best interest in mind.  It's not uncommon for companies to push for a quick settlement while you are still assessing the severity of your injuries. Workers' Compensation – If you are injured on the job; the only way for you to have your employer pay your medical bills, your lost wages and any other compensation to which you may be entitled is through the workers' compensation laws.  Workers' Compensation is insurance paid by an employer to cover medical care and benefits for employees who are injured or disabled because of their job.  This insurance covers all types of injuries to employees, including : Back Injuries, Carpal Tunnel Syndrome, Slip and fall injuries, Cuts and Lacerations, Repetitive trauma Injuries, Burns, Broken Bones, etc.  These injuries are all compensable under the workers' compensation laws; even in most instances, if you were completely at fault.  The exceptions to this would include, intentionally injuring yourself, being intoxicated, horseplay or being injured intentionally be a co-employee.  Please be aware that these claims must be brought within the time frame of the Workers' Compensation laws or it will be forever barred; so please call Anthony W. Social Security Disability – If you are considering filing an application for Social Security Disability, or have already been rejected; you may find that having an attorney's assistance will be helpful.  To be considered disabled, you must prove that you cannot do any type of work for which you are suited because of a medical condition, and your condition is expected to last for at least one year, or is terminal.  If benefits have been denied, reduced, terminated, or the SSA notifies you of any other actions against you, file for "reconsideration" immediately. You have only 60 days to file an appeal; but if you appeal within 10 days of being notified of a disability benefit action, you may be able to continue receiving payments while you appeal the decision.  Always remember to continue your medical care and keep document all Doctors and hospitals which may have records of your treatment.  Should you require any further information, then please call Anthony W. Civil Litigation - Civil litigation occurs when a legal dispute between two or more parties arises that seeks money damages or specific performance rather than criminal sanctions. A lawyer who specializes in civil litigation is known as a "litigator" or "trial lawyer." Criminal – Criminal law is the body of law that relates to crime. Criminal law differs from civil law, whose emphasis is more on dispute resolution and victim compensation than on punishment.  Anthony W. Traffic – Traffic law encompasses a number of different types of charges.  Whether you have been charged with speeding, red light or stop sign violation, careless and imprudent driving, DWI or any other moving violation in Missouri or Illinois; Anthony W. Winker can help.  In Missouri, the goal is to obtain a disposition that will allow our clients to avoid a conviction on his or her record and therefore the points which will be assessed on your license.  If you receive 8 points in 18 months, your license will be suspended for 30 days; 8 in 18months, 12 in 24 months, or 24 in 36months all will result in a 30-day suspension. If a person receives 12 points in 12 months, a one-year revocation will occur. A reduction of points occurs when a driver goes a full year without receiving any convictions. Upon a full year of driving without accumulating any points will result in 1/3 of the points being removed from your driver's record; after the 2nd year of driving conviction free, half of the rest of the points will be removed, and finally, after the third consecutive year of driving conviction free, the remaining points will be removed.  So, as you can see, not accumulating any points is the best way to handle this matter, so if you have been charged, call Anthony W. Family/Domestic – Family and Domestic Relations law encompasses many different fields such as divorce, paternity, spousal support, child support and child custody.  These are the types of issues that will truly impact your life in a variety of ways and are highly emotional.  We try to make this painful experience as easy as possible by clearly explaining all of your options at every point in the process and help you pursue the results you want in these matters.  We realize that every client has unique and specific needs. Probate - After a person dies, ownership (the legal title) of his or her property, assets and personal effects must be passed on (legally transferred) to the beneficiaries (heirs) listed in the Will. If there is no Will, the persons receiving assets are designated by State law. "Probate" is the legal name given to this process.  This can obviously be a very difficult time for those involved and the assistance of Anthony W. Estate Planning – Estate planning is the process of anticipating and arranging for the disposal of an estate. Estate planning typically attempts to eliminate uncertainties over the administration of the estate in probate.  Estate planning involves the will, trusts, beneficiary designations, powers of appointment, property ownership (joint tenancy with rights of survivorship, tenancy in common, tenancy by the entirety), gift, and powers of attorney, specifically the durable financial power of attorney and the durable medical power of attorney, including the drafting of a living will. Specific final arrangements, such as whether to be buried or cremated, are also often part of the documents.
